Abdolsamad Khoramshahi , defense attorney of Delara Darabi told Etemaad newspaper in Iran that within the past few days he was able to file his appeal with the supreme court of the Islamic Republic of Iran. “I am very hopeful that the previous verdict …gets vacated because there are many flaws in file and I am confident that new five judges will realize such inaccuracies” He added.
Mr., Khoramshahi in his comments to Etemaad newspaper stated : “By sending the file to discovery department once again the the hanging rope has taken its shadow from Delara’s head and I am hopeful that with detail investigation the new judges would vacate the verdict, because the prior confession is in contrast with the the facts. If the crime scene gets reconstructed, it will become very obvious that Delara was not the murderer and because she is left handed. If as it is currently stated in the file she had attacked the victim from the back, the stabs would have been on the left side of the victim not her right side. The only one that Delara stabbed was AmirHossein which was very obvious AmirHossein had even filed a complain against Delara for the stabbing but llater suddenly removed his complaint”. Delara’s attorney added” ” There are many vague areas in the case which if investigated with transfer of the file to the discovery department such ambiguities could be cleared”. (Delara had stated in her letter to previous judge that she actually in shock and in defense of the victim had stabbed the boyfriend when he attempted to kill the victim)
About Delara’s emotional status Mr. Khoramshahi said that initially : ” Verification of the death penalty extremely shocked Delara which added to her illness but now that she realized (new) different judges will investigate her case, she is in a better condition”
In Nazanin case also the file was re-investiagted by 5 new judges which after discovery it resulted in unanimous vote in favor of Nazanin’s innocence. This is great news and we look forward to better news for Delara who has been imprisoned for the past three years since she was 17 years old. Regardless regime in Iran is in violation of it’s UN obligations by having Delara and at least 20 other youth sentenced to death for alleged crimes when under 18 years of age.
